Can i get married at the courthouse without the divorce decree? divorce is definitaly final.?

the divorce certificate will not get here on time. can we still get married?and turn it in later if it becomes an issue. if he's definitely divorced then do we really have too acknowledge to the courts that he was married at the time of us getting our marriage liscense and getting with the justice of the peace? help in a panic!
